Terms and Conditions for YepYet POS and Online Ordering Platform
1. Acceptance of TermsBy using the YepYet POS and Online Ordering Platform ("Service"), you agree to be bound by these terms and conditions. You must fully read and accept these terms before using the Service.
2. License to Use
YepYet grants you a non-exclusive, non-transferable, revocable license to use the POS software and online ordering services solely for your business operations. Unauthorized use, duplication, or modification of the software is strictly prohibited.
3. User Responsibilities
You agree to:
- Provide accurate, complete, and current information during registration and ongoing usage.
- Maintain the confidentiality and security of your login credentials and account information.
- Promptly notify YepYet of any unauthorized use of your account or breach of security.
- Comply with all applicable local, national, and international laws and regulations related to your use of the Service.
4. Payment and Fees
- All fees associated with YepYet services are clearly outlined upon registration.
- Payments must be made according to the agreed terms and billing cycle.
- Late payments may result in additional charges, suspension, or termination of the Service.
- YepYet reserves the right to adjust pricing with prior notice provided at least 30 days in advance.
- Payment processing is handled securely by third-party payment providers; YepYet does not store or directly process payment information.
5. Data Security and Privacy
- YepYet fully complies with GDPR and other relevant data protection regulations.
- All data collected, stored, and processed by YepYet is encrypted and securely managed.
- YepYet will not sell or distribute your data to third parties without explicit consent unless legally obligated to do so.
6. Liability and Limitations
- YepYet is not liable for any indirect, incidental, consequential, or punitive damages resulting from the use or inability to use the Service, including but not limited to lost profits, business interruption, or data loss.
- YepYet's total liability under these terms shall not exceed the fees paid by you for the Service during the three months preceding the claim.
7. Service Availability and Support
- YepYet strives to maintain continuous service availability but does not guarantee uninterrupted or error-free operation.
- Scheduled maintenance or unforeseen downtime may occur; YepYet will endeavour to provide advance notification of any disruptions.
- Customer support is available to address technical issues or operational questions and will respond promptly during regular business hours.
8. Termination
- Either party may terminate the Service with a written notice of at least 30 days.
- YepYet reserves the right to immediately suspend or terminate access without prior notice if the terms are violated or payment obligations are not fulfilled.
9. Intellectual Property Rights
- All rights, titles, and interests in and to YepYet software, services, and content, including all intellectual property rights, remain exclusively with YepYet.
- You are prohibited from reproducing, modifying, distributing, or creating derivative works from the YepYet software or content without explicit written permission.
10. Changes to Terms
- YepYet reserves the right to modify these terms and conditions at any time.
- Changes will be communicated to all users, who must acknowledge and accept updated terms to continue using the Service.
11. Governing Law and Jurisdiction
- These terms and conditions are governed by the laws of the Republic of Ireland.
- Any disputes arising from or related to these terms or the Service shall be subject to the exclusive jurisdiction of Irish courts.
